من موسوعة المصطلحات الإسلامية

المعنى الاصطلاحي

A general comprehensive rule through which deduction of legal rulings is derived from the detailed proofs.

الشرح المختصر

"َQā‘idah usooliyyah" (rule of juristic principle) is a principle or criterion that was developed for jurists or mujtahids to properly deduce legal rulings from their detailed proofs. It falls midway between proofs and rulings. Its subject always combines the rule and the proof. For example, it is said that "an absolute command indicates obligation," and that "a prevention indicates prohibition." Other examples include rules of words, abrogation, giving preference, etc. The detailed proofs include the Qur’an, the Sunnah, etc.
